吉安市人民代表大会常务委员会规范性文件备案审查工作试行办法
(2012年8月28日吉安市第三届人民代表大会常务委员会第七次会议通过)
第一条 为规范和加强规范性文件备案审查工作,保障吉安市人民代表大会常务委员会(以下简称市人大常委会)依法行使监督职权,维护法制统一,根据《江西省实施〈中华人民共和国各级人民代表大会常务委员会监督法〉办法》和有关法律、法规规定,参照《江西省人民代表大会常务委员会规范性文件备案审查工作程序(试行)》,结合本市实际,制定本办法。
第二条 本办法所称的规范性文件是指吉安市人民政府(含经市人民政府授权或批准的政府组成部门、办事机构、直属机构)、市中级人民法院、市人民检察院和各县(市、区)人民代表大会及其常务委员会,依照法定职权和程序制定、发布的,对公民、法人或者其他组织的权利、义务具有普遍约束力的行为规则的总称。具体为:
(一)市人民政府(含经市人民政府授权或批准的政府组成部门、办事机构、直属机构)依照法定程序和职权制定和发布的决定、命令、规定、办法、通告等;
(二)市中级人民法院制定的指导审判工作、市人民检察院制定的指导检察工作的规定、办法;
(三)县(市、区)人民代表大会及其常务委员会就本行政区域内的重大事项通过的决议、决定,以及审议通过的其他规范性文件。
(四)其他依法应当报送备案的规范性文件。
第三条 市级行政、审判、检察机关和县(市、区)地方国家权力机关人事、财务等内部管理方面的规范性文件,部署阶段性工作的文件,人事任免决定,向上级行政机关的请示和报告,对具体事项的通报、通知、批复以及行政处理决定等,不属本办法规定之备案审查范围。
第四条 规范性文件制定机关对其所制定、发布的规范性文件负责。
市级行政、审判、检察机关和县(市、区)地方国家权力机关,应当依法履行规范性文件备案的职责,并加强对规范性文件备案工作的组织领导和对下级的监督指导。
第五条 内务司法委员会为市人大常委会规范性文件备案审查工作机构,承担备案审查的具体工作,并与有关专门委员会或者常委会有关工作委员会共同审查。
内务司法委员会承办备案审查工作的具体职责是:
(一)备案文件的接收、登记、分送、存档等;
(二)在收到报送备案的规范性文件、审查要求或者审查建议按照职责分工,将规范性文件转有关的专门委员会或常委会工作机构进行审查;
(三)向省人民代表大会常务委员会报送市人民代表大会及其常务委员会应当报送备案的规范性文件;
(四)负责对年度规范性文件备案审查情况进行汇总;
(五)于下年第一季度向市人大常委会主任会议报告本年度规范性文件备案审查工作汇总情况;
(六)办理本办法中与其相关的事项。
(七)承办主任会议交办的相关工作。
第六条 市人民政府(含经市人民政府授权或批准的政府组成部门、办事机构、直属机构)制定的规范性文件在发布之日起三十日内向市人大常委会报送备案。
市中级人民法院、市人民检察院制定的指导审判、检察工作的规定、办法在发布之日起三十日内向市人大常委会报送备案。
各县(市、区)人民代表大会及其常务委员会作出的决议、决定在发布之日起三十日内向市人大常委会报送备案。
上述制定规范性文件的机关应落实具体部门和人员负责市人大常委会备案审查工作中的报送和承办事宜。
第七条 报送规范性文件备案应当以制定机关正式文件的形式,包括备案报告、规范性文件的正式文本及说明等,装订成册,一式五份,并附电子文本。
规范性文件说明应当包括以下内容:
(一)制定的必要性及法律依据;
(二)规范性文件的主要内容;
(三)其他需要说明的问题。
备案报告由版头、发文字号、标题、主送机关、正文、发文机关印章、发文时间等部分组成。
第八条 规范性文件的制定机关应当报送备案而没有报送备案或者不按时、未按要求报送规范性文件备案的,由内务司法委员会通知制定机关限期补报或者重新报送备案;逾期不报送的,可以对有关机关给予通报批评,并责令限期改正。
第九条 规范性文件的制定机关,应当在每年1月31日前,将上一年度制定的规范性文件目录报送内务司法委员会。目录的内容包括规范性文件的标题、制定或者发布机关名称、文件字号、发布时间、生效时间、有效期等。
第十条 对报送备案的规范性文件,内务司法委员会应当及时进行备案登记,并在七个工作日内按照职责分工分送有关专门委员会或者常务委员会工作委员会。
规范性文件的内容涉及两个或者两个以上专门委员会或者常务委员会工作机构职责范围的,应当明确主办委员会,同时分送有关专门委员会或者常务委员会工作委员会。
第十一条 各专门委员会、常委会各工作委员会对接到的规范性文件,重点审查是否存在下列情形:
(一)超越法定权限,限制或者剥夺公民、法人和其他组织的合法权利,或者增加公民、法人和其他组织的义务的;
(二)违反法定程序制定的;
(三)同宪法、法律法规相抵触的;
(四)同上级或者本级人民代表大会及其常务委员会决议、决定相抵触的;
(五)有其他不适当问题的。
第十二条 市人民政府(含政府组成部门、办事机构、直属机构)、市中级人民法院、市人民检察院、县(市、区)人民代表大会常务委员会认为规范性文件有本办法第十一条所列情形的,可依法向市人大常委会书面提出审查要求。内务司法委员会应当及时进行登记,并自收到审查要求之日起七个工作日内转送有关专门委员会或者常委会工作委员会进行审查,提出意见。
前款规定以外的其他国家机关、社会团体、企事业单位或者公民认为规范性文件有本办法第十一条所列情形,可依法向市人大常委会书面提出审查建议。内务司法委员会接收后应当及时进行登记,并自收到审查建议之日起十五个工作日内研究决定是否进行审查。不进行审查的,及时告知审查建议人;需要进行审查的,转送有关专门委员会或常委会工作委员会进行审查,提出意见。
对不属于市人大常委会备案范围的审查要求或审查建议,内务司法委员会应当自收到之日起十日内,告知审查要求人或者审查建议人向有权审查的机关提出。
第十三条 书面提出审查要求或审查建议,应当写明建议或者要求审查的规范性文件的名称、审查的事项和理由。
第十四条 有关专门委员会或者常委会工作委员会认为备案的相关规范性文件有本办法第十一条所列情形的,可以主动进行审查,提出初步审查意见,送内务司法委员会按本办法有关规定办理。
内务司法委员会认为备案的规范性文件有本办法第十一条所列情形的,可以提出书面建议,转送有关专门委员会或者常委会工作委员会进行审查。
第十五条 有关专门委员会或常委会工作委员会应当自收到内务司法委员会转送的审查要求、审查建议之日起两个月内,对规范性文件进行审查,有特殊情况的,经市人大常委会有关领导同意,可延长一个月。
在规范性文件审查中,有关专门委员会或常委会工作委员会应当加强与制定机关的联系沟通,可以向制定机关了解有关情况,要求制定机关提供有关材料,必要时可以召开有关会议听取意见。
第十六条 对有关专门委员会或者常务委员会工作委员会提出的初步审查意见,内务司法委员会应当自收到之日起一个月内进行审查。
内务司法委员会审查后,在十五日内与有关专门委员会或者常委会工作委员会召开联合审查会议,认为规范性文件有本办法第十一条所列情形时,由内务司法委员会提出书面审查意见,报经市人大常委会主任会议研究决定后,由内务司法委员会将书面审查意见送交规范性文件制定机关。
第十七条 规范性文件制定机关应当自收到书面审查意见之日起两个月内,提出是否修改或者废止规范性文件的意见,并将该意见一式五份向内务司法委员会书面反馈。内务司法委员会应当将制定机关的书面反馈意见及时分送有关专门委员会或者常委会工作委员会,并向市人大常委会有关领导报告。
第十八条 规范性文件制定机关提出修改或者废止规范性文件意见的,该制定机关应当自书面反馈之日起两个月内对该规范性文件进行修改或者废止;修改或者废止的情况应及时向社会公布,并按照本办法第六条、第七条之规定重新报市人大常委会备案。
规范性文件制定机关提出不予修改或者废止规范性文件的意见,内务司法委员会应当对该意见进行认真研究,并商有关专门委员会或者常委会工作委员会提出处理意见,报经市人大常委会主任会议研究决定后,由内务司法委员会反馈规范性文件制定机关。
第十九条 对同宪法、法律、法规相抵触或有其他不适当问题应当修改或废止而制定机关不予修改或者废止的规范性文件,有关专门委员会或常委会工作委员会可以提出撤销该规范性文件的议案或建议,由市人大常委会主任会议决定提请市人大常委会审议决定;撤销规范性文件的议案列入市人大常委会审议的,依照市人大常务委员会议事规则的有关规定办理。
第二十条 市人大常委会撤销报送备案的规范性文件的决定,应当向社会公布。
第二十一条 内务司法委员会应当自规范性文件审查工作结束之日起十日内,将审查结果书面告知审查要求人或者审查建议人。
第二十二条 各专门委员会、常委会各工作委员会每年的工作总结报告中,应当包含规范性文件备案审查情况。内务司法委员会应于每年1月31日前,将上年度审查完毕的规范性文件及其资料集中统一移交市人大常委会办公室归档。
第二十三条 本办法由市人大常委会主任会议负责解释。
第二十四条 本办法自通过之日起试行。

PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD

There is hereby established a board to be known as the Protection
of

The Board shall consist of a Chairman appointed under the Schedule

more than 10 members appointed by the Governor as follows--

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

Where the Commissioner exercises his discretion under
subsection (1)

Verification of application
For the purpose of verifying any application under section 15,
or if
